Welcome to mypiceffects.com. These Terms & Conditions ("Terms") govern your use of our website, photo effects service, video animation service, and REST API ("Service"). By accessing or using mypiceffects.com, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, applying an effect, calling our API, or otherwise using mypiceffects.com, you confirm that:

• You have read, understood, and agree to these Terms.
• You agree to our Privacy Policy.
• You have the legal authority to enter into this agreement.

2. Eligibility

You must be at least 13 years old to use mypiceffects.com. If you are under 18, you should review these Terms with a parent or guardian. We reserve the right to refuse service or terminate accounts that we believe violate this requirement.

3. Accounts & API Keys

3.1 Account creation

• You may register one account per person. Multiple accounts created to abuse free credits will be terminated.
• You must provide accurate and current information when registering.
• You are responsible for keeping your password and API key confidential.
• You are responsible for all activity that occurs under your account.

4.1 How credits work

• 1 credit = 1 photo effect (image result).
• 2 credits = 1 video animation effect (MP4 result).
• Credits are deducted only on successful generation. Failed requests do not consume credits.
• Credits never expire — they remain in your account until used.

4.2 Signup bonus & daily free credits

• New accounts receive 50 free credits on signup.
• All users can redeem 10 free credits per calendar day from the dashboard.
• Daily credits are a courtesy. We reserve the right to change the daily amount, the redemption rules, or to discontinue the daily free credit programme at any time, with or without notice.

4.3 Guest mode

• Non-registered visitors can apply up to 2 free effects per browser session without creating an account.
• Guest limits are enforced per browser session and may reset if you clear cookies. Repeated abuse of guest mode to bypass account requirements may result in IP-level blocking.

5. Paid Plans & No Refund Policy

5.1 Purchasing credits

Paid credit plans are available starting from $5. Pricing is shown on our pricing page and is subject to change. The price displayed at the time of purchase is the price you will be charged.

5.2 No refunds — all sales final

5.3 Taxes

You are responsible for any applicable taxes, duties, or fees imposed by your jurisdiction in relation to your use of paid plans.

6. Acceptable Use

You agree to use mypiceffects.com only for lawful purposes and in accordance with these Terms. You must not:

• Use the Service in any way that violates applicable laws or regulations.
• Upload photos you do not own or do not have permission to use.
• Use the Service to harass, defame, threaten, or harm others.
• Attempt to gain unauthorised access to other users' accounts or our systems.
• Reverse-engineer, decompile, or otherwise attempt to extract source code from the Service.
• Scrape, mass-download, or automate the Service in ways that exceed published rate limits.
• Resell, rebrand, or repackage the Service as your own without prior written permission.
• Use the Service to create or train competing AI models.

7. Prohibited Content

Regardless of any other policy, the following content is strictly prohibited on mypiceffects.com:

We reserve the right to refuse processing of any content we determine, at our sole discretion, violates these rules. We may report illegal content to appropriate authorities.

8. Your Content & Our Content

8.1 Your photos remain yours

You retain all rights, title, and interest in the photos you upload. We do not claim ownership of your photos. By uploading, you grant us a limited, temporary license to process your photo solely for the purpose of generating the requested effect output and delivering it to you. This license terminates as soon as processing completes.

8.2 Output ownership

The output (transformed photo or video) is yours to use, share, sell, or modify freely, subject to:

• You must have had the right to upload the input photo in the first place.
• The output must not be used in any way prohibited by section 7.

8.3 Our platform & effects

mypiceffects.com, including the website design, source code, effect library, branding, logos, and documentation, is owned by us and protected by intellectual property laws. You may not copy, modify, redistribute, or create derivative works of our platform without our prior written permission.

9. API Usage Rules

The mypiceffects.com REST API is provided for legitimate integration into your own applications, bots, websites, or workflows. When using the API:

• You must include a valid Bearer token in every request.
• You must respect rate limits (currently 30 requests per minute per API key).
• You must not resell raw API access as your own service.
• You must not share your API key with third parties; instead, build them their own integration.
• Excessive failure rates (more than 50% errors over an extended period) may result in temporary throttling.
• Automated abuse, including credit farming through multiple accounts, will result in permanent termination.

10. Effects Availability

Reasons an effect may be discontinued include but are not limited to: changes from our upstream processing provider, quality issues, low usage, content policy updates, or technical limitations.

11. Service "As Is" / No Warranty

The Service is provided on an "as is" and "as available" basis. We make no warranties, express or implied, including but not limited to:

• That the Service will be uninterrupted, error-free, or available at any specific time.
• That every effect will produce the expected or desired result.
• That the Service will meet your specific requirements.
• That defects will be corrected within a specific timeframe.

We may perform scheduled or emergency maintenance at any time. We will make reasonable efforts to minimise downtime but cannot guarantee continuous availability.

12. Suspension & Termination

12.1 By you

You may stop using the Service at any time. To request account deletion, contact us at mypiceffects@gmail.com. Note that any unused credits in your account will be forfeited and are not refundable.

12.2 By us

We may suspend or terminate your account, with or without notice, if we believe you have:

• Violated these Terms or our Privacy Policy.
• Uploaded any content prohibited under section 7.
• Engaged in fraudulent activity, including chargebacks or payment disputes.
• Abused the free credits system through multiple accounts.
• Attempted to harm the Service, other users, or our infrastructure.
• Failed to pay for any amounts owed.

Upon termination for cause, all unused credits are forfeited without compensation.

13. Limitation of Liability

To the maximum extent permitted by applicable law:

• mypiceffects.com and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business, or goodwill.
• Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you have paid us in the 12 months prior to the event giving rise to the claim, or USD 50, whichever is greater.
• We are not responsible for the content of photos you upload, results generated, or how you use those results.
• We are not responsible for any third-party use of your API key.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes that affect your rights or obligations, we will also notify registered users by email or by a prominent notice on the website at least 14 days before the changes take effect.

Continued use of the Service after changes take effect means you accept the updated Terms. If you do not agree with the changes, you must stop using the Service.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation first, and failing that, before the competent courts in India.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
